IdentifyThis.app ("the Service") is a web-based AI-powered identification platform that allows users to upload photos and receive AI-generated identification results for plants, bugs, mushrooms, rocks, trees, objects, and other items. The Service is provided by IdentifyThis.app ("we," "us," or "our").

2. User Accounts

To use the identification features of the Service, you must sign in using your Google account. By signing in, you agree to provide accurate account information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms
Use the Service to generate spam, misleading content, or automated bulk requests
Interfere with or disrupt the Service or servers or networks connected to the Service
Resell, redistribute, or commercially exploit the Service without our written permission
Impersonate any person or entity or misrepresent your affiliation with any person or entity

4. AI Accuracy Disclaimer

The identification results provided by the Service are generated by artificial intelligence and are not guaranteed to be accurate. AI identification should be used as a helpful starting point, not as a definitive determination. You acknowledge and agree that:

AI-generated identifications may contain errors, especially for rare, unusual, or visually similar species
The Service should never be used as the sole basis for determining the edibility or safety of mushrooms, plants, berries, or any other organism. Misidentification of toxic species can result in serious illness or death.
The Service should not be used as a substitute for professional medical, veterinary, geological, or entomological advice
We are not liable for any harm, injury, illness, death, property damage, or other loss resulting from reliance on AI-generated identification results
You assume full responsibility for any actions taken based on identification results

5. Intellectual Property

The Service, including its AI models, design, code, text, graphics, and other content, is owned by IdentifyThis.app and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of photos you upload but grant us a limited, non-exclusive license to process your images for the purpose of providing identification results. This license terminates when the identification is complete.

6. Payment Terms

The Service offers paid subscription plans at the following rates:

Weekly plan: $3 per week
Monthly plan: $10 per month

Payments are processed through our third-party payment provider. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds are handled on a case-by-case basis at our discretion.

7. Privacy & Data Processing

We respect your privacy. Photos uploaded for identification are processed by our AI system and are not stored on our servers after identification is complete. We do not sell, share, or distribute your uploaded images to third parties. Account information associated with your Google sign-in (name and email address) is stored securely and used only for account management and communication purposes. 8. Limitation of Liability

To the maximum extent permitted by applicable law, IdentifyThis.app and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your use of or inability to use the Service
Any errors, inaccuracies, or omissions in AI-generated identification results
Any actions taken or not taken based on identification results
Unauthorized access to or alteration of your data
Any third-party conduct on the Service

In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

11. Termination
